Supreme Court Upholds Communal Rotation in CUSAT Act, Rejects Appointment of SC Candidate

Supreme Court dismissed the petition of SC candidate Radhika T., upholding the Kerala High Court’s decision

The Supreme Court held that the rule of communal rotation in university appointments remains applicable even during the validity period of the rank list.

If a selected candidate resigns, a candidate on the waiting list does not automatically gain the right to the job solely on that basis.- SC

In fact, on October 22, 2019, the Cochin University of Science and Technology (CUSAT) had issued a recruitment notification for one position of Associate Professor in the Department of Inorganic Rasan Science. This recruitment was reserved for SC candidates that year.

When the results came out, Dr. Anita C. Kumar secured the first position, and Radhika T. secured the second position.

After working for a year, Dr. Anita C. Kumar resigned on March 30, 2022, after securing a professor position in another university.

After this, Radhika applied for this job, but CUSAT refused by citing a lien in favor of the first party. Subsequently, her claim was rejected by invoking the matter of communal rotation.

In the university, “lien in favor” means that if any teacher or employee is appointed to another institution or position for a temporary period, their original permanent position remains secure. Upon completion of the stipulated period, they can resume duties on their former post.

After this, Radhika approached the Kerala High Court. The High Court also dismissed Radhika’s petition. The High Court ruled in favor of the university and upheld the communal rotation.

It may be noted that the next turn for this post was for the Latin Catholic or Anglo Indian category.

After this, Radhika had filed a petition in the Supreme Court. Now, the Supreme Court has upheld the High Court’s order and affirmed the communal rotation rule.
